Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Larkite provides the PushToApp software, a desktop application that allows users to build mobile applications from templates using artificial intelligence. The Service includes the software, the website, and any related services.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for safeguarding your account password and for any activities or actions under your password. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

a. Plans

We offer several subscription plans, including a free tier and paid tiers ("Plans"). Each Plan includes a specific number of "app build credits" ("Credits").

b. Billing

Paid Plans are billed on a recurring monthly basis. By purchasing a Plan, you authorize us to charge your payment method on a recurring basis until you cancel.

c. Cancellation

You may cancel your subscription at any time through your account dashboard. Your subscription will remain active until the end of the current billing period.

5. Credit System

• One (1) Credit is consumed for each app build you initiate.
• Unused Credits on paid Plans roll over to the next billing period.
• Credits have no cash value and are non-transferable.

6. Refund Policy

Subscription fees are non-refundable. If you cancel your subscription, you will not receive a refund for the current billing period, but you will not be charged for subsequent periods.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Larkite LLC.

You retain full ownership of the application source code you generate using the Service. We claim no intellectual property rights over the materials you create.

8. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To generate applications that are malicious, fraudulent, or violate the terms of service of any third-party platform (e.g., Apple App Store, Google Play Store).
• To reverse-engineer or attempt to extract the source code of the PushToApp application itself.

9. Limitation of Liability

In no event shall Larkite LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Larkite LLC is registered, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
